Acrylic King – Terms and conditions
1. Applicability
1.1 These general conditions apply to all offers, orders and agreements of Acrylic King.
1.2 Accepting an offer or placing an order means that you accept the applicability of these conditions.
1.3 Deviations from these terms and conditions are only valid if they have been expressly agreed with Acrylic King in writing.
1.4 If (a) provision(s) of the terms and conditions is/are null and void or annulled, the remaining provisions of these terms and conditions will remain in full force, Acrylic King and the customer will then consult with a view to agreeing on (a) new provision(s) to replace the void or annulled provision(s), taking into account as much as possible the objective and purport.
1.5 These conditions respect the consumer’s rights under the law (or the sales contract).
2. Offers and agreements
2.1 All offers of Acrylic King are without obligation and Acrylic King expressly reserves the right to change prices. All offers are subject to availability.
2.2 An agreement is established only after acceptance of your order by Acrylic King, following the complete and correct completion of the order form on Acrylic King ‘s website. An agreement is concluded at the time Acrylic King sends the order confirmation to the buyer.
2.3 Acrylic King is entitled to refuse orders or to attach certain conditions to the delivery, unless explicitly stated otherwise.
2.4 If an order is not accepted, Acrylic King will notify you within ten (10) days of receiving the order.
2.5 In case an item is not yet in stock and orders are being collected for that item, Acrylic King is not yet obliged to deliver this item, the items will be delivered as soon as it comes into stock.
2.6 The Buyer and Acrylic King expressly agree that a valid agreement is concluded through the electronic form of communication as soon as these conditions and the ordering procedure have been met.
2.7 The order confirmation shall include at least the following information:
A description of the product purchased by the customer, the item number, and the number of products purchased by the customer.
The price of the product in euros.
The order number of the agreement.
Acrylic King’s email address, where the customer can go with questions about the order.
3. Prices and Payments
3.1 The prices mentioned for the offered articles and are in Euros, exempt from VAT because of the small entrepreneurs scheme (KOR) and exclusive of shipping costs, any taxes or other levies, unless otherwise stated or agreed in writing. All prices are subject to change.
4. Delivery / Delivery Terms
4.1 The delivery period for the item (if in stock) shall be a maximum of 30 days or as much shorter as possible.
4.2 Exceeding the delivery time does not entitle you to compensation or the right to cancel your order or to dissolve the agreement, unless the exceeding of the delivery time is such that you can not reasonably be required to maintain the agreement. You are in that case entitled to cancel the order or to dissolve the agreement to the extent necessary.
4.3 Delivery of the items shall be made at the place and time when the items are ready for shipment to the customer.
5. Right of withdrawal
5.1 After the customer has received the ordered item, the customer is obliged to carefully inspect the products (or have them inspected) immediately upon receipt.
5.2 The consumer has the right to notify the seller that he renounces the purchase, without payment of a penalty and without giving any reason within 14 days from the day the order is delivered or on the conclusion of the service agreement. The customer must then return the item within 14 days. If the customer wishes to dissolve the agreement as a result of article 6.1 of these terms and conditions, you must notify Acrylic King in writing (via letter or e-mail). The customer must send the item to a return address determined by Acrylic King. The direct cost of return shipping shall be borne by the customer.
5.3 Acrylic King reserves the right to refuse returned items or to credit only a portion of the purchase price if it is suspected that the item has already been used or damaged through the fault of the customer (other than Acrylic King or the supplier of the item).
5.4 If an item is returned that, in Acrylic King ‘s opinion, has sustained damage that is attributable to an act or omission of the customer or is otherwise at the customer’s risk, Acrylic King will notify the customer. Acrylic King has the right to deduct from the amount to be refunded to the customer the depreciation of the item due to this damage.
5.5 The purchase price of the part of the order returned by the customer will be refunded to the customer.
5.6 Claims and defenses that the delivered product does not comply with the agreement, lapse six months after receipt by the customer.
6. Orders/Communications.
6.1 In the event of misunderstandings, damage, delays or improper transmission of orders and notifications as a result of the use of the Internet or any other means of communication in the traffic between the customer and Acrylic King, or between Acrylic King and third parties, to the extent related to the relationship between the customer and Acrylic King, Acrylic King is not liable.
7. Force Majeure
7.1 Without prejudice to its other rights, in the event of force majeure Acrylic King has the right, at its option, to suspend the execution of your order or to dissolve the contract without judicial intervention, by informing you of this in writing and without Acrylic King being obliged to pay any compensation, unless under the given circumstances this would be unacceptable according to the standards of reasonableness and fairness.
7.2 Force majeure means any shortcoming that cannot be attributed to Acrylic King, because it is not due to its fault and is not for its account under the law, legal act or generally accepted practice.
7.3 Acrylic King has the right to invoke force majeure if any circumstance prevents (further) performance.
8. Risk
8.1 The risk during transport of the product ordered by the customer is for Acrylic King. At the time of delivery of the product, or the time that can reasonably be considered delivery, the risk of the product passes to the customer, except for those liabilities that cannot be legally excluded by Acrylic King.
9. Warranties
9.1 The products delivered by Acrylic King are subject only to the guarantee as determined by the manufacturer of the relevant product. Acrylic King performs only a counter function during such a warranty period.
9.2 The products delivered by Acrylic King are covered by a 12-month warranty from the date of purchase against manufacturing defects, unless otherwise stated.
10. Complaints
10.1 All complaints related to the delivery, quality, capacity of the product or any other complaint, will be seriously considered by Acrylic King.
10.2 The customer must make a complaint in writing to Acrylic King within fourteen (14) days.
10.3 Acrylic King will attempt to resolve the complaint within ten (10) business days. Acrylic King will notify the customer accordingly.

12. Rights
12.1 If you provide Acrylic King in writing with a delivery address, Acrylic King is entitled to send all orders to that address unless you provide Acrylic King in writing with another address to which your orders should be sent.
12.2 If deviations from these Terms and Conditions have been permitted by Acrylic King for a short or long period, tacitly or otherwise, that does not affect its right to still demand direct and strict compliance with these Terms and Conditions. You can never assert any right on the basis of the fact that Acrylic King applies these conditions flexibly.
12.3 If one or more of the provisions of these Terms and Conditions or any other agreement with Acrylic King is in conflict with any applicable legal provision, the provision in question will lapse and will be replaced by a new comparable provision that is permissible under the law, to be determined by Acrylic King.
12.4 Acrylic King is authorized to use third parties in the execution of your order(s).
12.5 All rights, obligations, offers, orders and agreements to which these conditions apply, as well as these conditions, are exclusively governed by Dutch law.
12.6 All disputes between the parties shall be referred exclusively to the competent court in the Netherlands.
12.7 All images, data regarding dimensions, colors, etc. are approximate only. Deviations from reality cannot be a reason for compensation and/or dissolution.
